Alexander R. Xavier, an individual surety in Florida, has been sentenced to a total of 12 and a half years following a conviction for defrauding federal agencies by issuing fraudulent bonds for public construction projects. According to the Department of Justice, over the course of two years, Xavier falsely pledged more than $25 million in collateral to secure the bonds, but had no real assets. His scheme defrauded federal agencies of more than $400,000 in bond fees. As a result, the court sentenced Xavier to 150 months on Count 1, 120 months on Count 2, and 60 months on Count 3, but with the sentences to run concurrently. He also was ordered to pay $4,165,221.44 in restitution jointly and severally with the restitution ordered against Brian Garrahan and Kelly Spillman in Case No. 15-cr-80224.
